1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Nixus (the "Service"), operated by Nixus ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
2. Eligibility
You must be at least 16 years old to use the Service. By using Nixus, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials, including your password and any two-factor authentication codes. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account information up to date.
- Notify us immediately of any unauthorized access or security breach.
- Not share your account with anyone else.
We are not liable for any loss or damage arising from your failure to secure your account. You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Infringe the rights of any third party, including intellectual property rights.
- Send spam, phishing messages, or any form of unsolicited communication.
- Upload malware, viruses, or any code designed to disrupt the Service.
- Attempt to gain unauthorized access to other users' accounts or data.
- Interfere with the operation of the Service or its infrastructure.
- Use automated tools (bots, scrapers) to access the Service without our consent.
- Impersonate any person or entity.
- Engage in any activity that is abusive, harassing, or harmful.
We reserve the right to suspend or terminate accounts that violate these rules.
5. Subscription & Payments
Nixus offers a free plan and several paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or yearly) through our payment provider (PayPal).
- Auto-renewal. Paid subscriptions renew automatically at the end of each billing period unless canceled.
- Price changes. We may change prices with 30 days' notice. Changes apply to your next billing cycle.
- Refunds. We offer a 30-day money-back guarantee on your first payment. Contact raissmohamadamine@gmail.com for refunds.
- Taxes. Prices exclude applicable taxes, which may be added at checkout.
- Failed payments. If payment fails, we may suspend your account after a grace period of 3 days.
6. Your Content
You retain all rights to the data you upload, create, or store in Nixus ("Your Content"), including client information, invoices, and payment records.
By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, back up, and display Your Content solely for the purpose of providing the Service to you. We do not use Your Content for any other purpose.
You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You represent that you have all necessary rights to upload it.
7. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content (excluding Your Content), is owned by Nixus or its licensors and is protected by copyright, trademark, and other laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
9. Availability & Support
We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.
Support is provided by email. Response times depend on your plan tier.
10. Termination
You may delete your account at any time from Settings → Data. Your data is retained for 30 days for recovery, then permanently deleted.
We may suspend or terminate your account if you violate these Terms, if required by law, or if your account is inactive for an extended period. We will provide notice where practicable.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any data will be accurate or reliable.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIXUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 if you are on the free plan.
13. Indemnification
You agree to indemnify, defend, and hold harmless Nixus and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights.
- Your Content.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last updated" date at the top of this page.
- Notify you by email or in-app for material changes.
Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of Casablanca, Morocco, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.
